Today I have been to court about the rent of the marital home. (as mentioned in my last post iliasm.org/thread/2162/bad-guy-acceptable)Stbx finally has a lawyer. At court my lawyer explained the situation. Not just the rent part but emphasizing that my stbx doesn't do anything else but demanding money from me and didn't even get a lawyer until the last judge told him to. His lawyer of course emphasized other aspects. Pour man suddenly abandoned and I don't pay anything (not true). Third lawyer was on behalf oft he landlord, the rent needs to be paid, marital problems or not. My lawyer asked for permission to only pay a part of the rent to postpone the issue until there is more clarity about finances after the upcoming court session in February. but the judge decided that I need to pay all the rent that is due up to now. She did say clearly to stbx that he needs to find a job and she also criticized on his behavior towards me and our daughter. Stbx says he is looking for a job now. I hope that is true, most likely he has registerd last week or so and probably has not done anything active yet. But maybe he does realize that sooner or later nothing else is possible for him. So I will do the payments for now. And in February next step. |

Well,at least you only have to pay what is due, and not a penny more. The judge has a clearer picture of what you are dealing with. Hopefully this will be in your favor pertaining to your daughter.

I'm glad you are acting on instructions though. This is better than paying it voluntarily, I think. Because later on in proceedings- the court system will see how STBX pushes every single issue to the last possible moment before acting at all responsible for himself. That won't reflect well on him, to judges.

Well,at least you only have to pay what is due, and not a penny more. The judge has a clearer picture of what you are dealing with. Hopefully this will be in your favor pertaining to your daughter. There will be lots of pennies more.... If I stop paying again after february, stbx won't be evicted before rent is due 3 months again and that rent will have to be paid too. plus extra costs. |

tamara68, it just shows that you can't depend on the legal system to be logical or fair. I fail to see how if both of your names are on the lease -- and he is an able-bodied man -- you should have to bear 100% of the cost. Hopefully your lease is due to expire soon and you can have yourself removed.

I fail to see how if both of your names are on the lease -- and he is an able-bodied man -- you should have to bear 100% of the cost. Hopefully your lease is due to expire soon and you can have yourself removed. He has to look for work. Hopefully he understands that however long I pay the bills, it is going to stop sometime. If he is not going to be able to pay the rent than the only other options is that I stop paying and get him evicted. He needs to look for a cheaper apartment very soon. But that is not easy. |

tamara68, one would like to use his hubris against him, like... if he considers himself so vastly intelligent, he should be expected to earn a commensurate income and be responsible for a proportionate amount of the expenses. It should not be your financial concern that he chooses to be a burden on society. Truly, there should be some target income that he is responsible for earning, even if it's just median income for the area. Alas, Justice is not just blind, she's twisted too.

DryCreek He is responsible for the rent as much as I am, but the money has to be paid so as long as he has nothing it will have to come from me. for now. He has almost no work experience so it will be hard to find a job. He will have to accept anything but I doubt he will do that. And besides that, who will hire him? Most people find him annoying at first or second glance. I hope he will get some help with the job hunting. Maybe there is something specially for annoying people lol.
