I haven't posted here in a while, but I have a problem I hope someone can help me with.
My husband hasn't worked in almost two years, but was getting workman's comp until last June. I have been paying all of the bills for the last 6 months. He finally got his settlement and paid off over $10000 on his credit cards that he had racked up in those six months. He paid off my one credit card bill of $1400 and refused to pay towards any of my school loans, whereas a huge fight ensued and he reversed my credit card payment He chose to leave and somehow closed out our joint checking account and opened his own accounts with the settlement money. I am going to try to see an attorney next week. I am wondering if I am entitled to any of the money from the settlement? He is currently out of State, probably buying a house for his sister. I am at a loss as to what to do and am infuriated, of course.

takestwototango get legal help right away, like yesterday. Don't wait until HE files. Money spent is more difficult to recover. I would say workers comp money is joint money to pay bills and living expenses just like wages. In this case, "after bills are paid" you two split the money 50-50. In a fair divorce anything you or he has is marital asserts to be equally shared or split equally. GO see a lawyer YESTERDAY.

Empty any joint accounts you have left and put the funds in accounts in your name only. Close any joint credit cards accounts you have. Have any non-retirement mutual funds or stocks? Cash them out and move the funds to accounts in your name only.
Finances get somewhat "equally" distributed in court, but until then a lot of finances can disappear. Get what you can quickly in the short term.

This is not going to help you Sister takestwototango , but is rather directed at newbies. Newbies .... You will often see in here suggestions to see a lawyer in your jurisdiction to establish how a divorce would shake out for you. This story by Sister takestwototango is a salutary lesson in why this suggestion is constantly made. Don't be a sitting duck. Get yourself fully informed.

More advice for newbies: remember the decision to divorce is not just up to you. In most jurisdictions, your spouse may divorce you whether or not you agree. Your SM could be due to their planning to divorce you at a time convenient for them.

The laws of your state determine how both property and debt is distributed. There are ways he can hide money, but you can catch him. Lying on a financial affidavit is bad mojo.
Why was he not working? Reducing income also reduces support payments. I'm wondering if he has a plan.
See a lawyer. Most will give you a free half hour consultation.

He was on Worker's Comp for almost a year and a half and just got his settlement and his attorney has filed for his disability, but it keeps getting turned down, 3 times so far.
He took the entire settlement and put it in a separate account under his name, so I have no access to it.

He took the entire settlement and put it in a separate account under his name, so I have no access to it. $$$ was a factor in my divorce. My ex moved money without my knowledge or consent.. With the help of my attorney, my ex, under oath, "had no idea" where 100's of thousands of dollars went to! ( this from the same woman who knew I spent $21.00 on 3 t shirts!) It ended up that I could prove She had it at one time, moved it, but what I could not prove was where is it! (or what was it spent on?) Your attorney can get all of his bank records subpoenaed, and then you may find it.

This is why members of this group are constantly advised to seek legal advice to see how a divorce would shake out in their jurisdiction. Your spouses actions in pocketing the full lump sum may have been legal - but also might not be - and you may be entitled to half of that lump sum. YOU NEED TO KNOW THIS STUFF. Hence - "see a lawyer" as soon as possible.
