JMX, time will tell, but I think a good sound bite here is "Find a lawyer you can trust, then trust your lawyer's advice". I'd wager a good divorce lawyer has see more refusers' antics than a therapist. One who is savvy will have a pretty darn good sense of how your STBX is likely to behave, and how to move the chess pieces. E.g., if he has a safety net with Mom out of state, odds are good that he'll exercise it if she enables him. Maybe not, but don't be surprised.
