I am back, they didn't want to keep me there lol In the Belgium law somewhere still is a rule that it is illegal to leave the marrital home. But the police officer (not the cute one btw) said that he had never had this before that someone referred to that rule. Nevertheless he needs to take it seriously. So he has noted my statements formally. He doesn't think I will hear more about it.
I am sure though, that my stbx will file more complaints an demands for money. Everything he can think of.

Money, money, money, MONEY! That's what I named my post, when I started this divorce. Seams to be the bulk of my story for now. Everything is now considered " marital assets", nothing can be sold, or traded. However there are daily necessities, and every day cost of living that meet the lifestyle you and the family have become accustomed to.
For example: our family truck needed an expensive repair. More than it's trade in value. My STBX wanted me to pay for it out of our years of savings. My attorney informed me those are daily living expenses, don't use your savings. My STBX refused to pay for it. I told my attorney how much she spent on her replacement car last year, and went way over on the budget. My attorney told me, " go and spend the same, it's a daily necessity, you and the family need that, spend it from the savings, like she did." Here in America, once my spouse starts leaving me with insufficient funds, that makes her in contempt of court. Which gives my attorney power. It's going to come down to " temporary relief funding" set by a judge. That puts an end to her control.
Also here in America, if I was to move out, it could be considered abandonment. I would loose all our marital assets, house, cars, everything. I have been informed, whatever you do stay in the house, let her leave. Different laws, different situation. I am very glad you and me have attorneys to walk us through these things!

What does the law say you are supposed to do? Divorce then move out? Just goes to show how much the laws change from jurisdiction to jurisdiction. In some of the United States, you can't divorce until you've been separated for quite some time.

@phinheasgage You don't have to divorce first, but I think often first a request for 'seperation of bed and table' (literal translation) is sent to a family court. Usually when people get separated before divorce, the spouse with the least money will ask for a verdict about solutions for the time until divorce is final. In my case it would be expected that my husband would ask that, but he still refuses to get a lawyer.

Gotta love the passive aggressive approach. I guess in any jurisdiction, it's a fundament principle of Western Jurisprudence, there's always a way to stall.

Yeah that's one thing at least in the US, as difficult as it may be, it's often legally disadvantageous to leave the marital home until a separation agreement is reached. I find it so odd that STBX will not hire a lawyer but managed to find out about a law that the police never see used. Who helped him do that? Maybe he spent hours reading law? It just strikes me so odd. tamara68 - I do hope the policeman is correct and that you don't hear more about it. If STBX is supposed to file this request, then he'll either figure out how to or else finally have to hire a lawyer to do it for him. Stay strong through it - it can be a slog, but it is worth it!

GeekGoddess and @phineasgage, he indeed has spent a lot of time reading about laws and as usually he thinks he knows best. I also think that is not very smart to do, and he is damaging his own interests. I could clearly notice that the police officer found my stbx's letter very strange.
