This is a no fault area.
Where she is moving is where we were planning on moving together before we split...she's stil going anyway. Neither of us knows anybody there which was part of the appeal as we both have toxic family members...
She is considering moving to another area instead as there is a job opening she might get, if she does she will go there instead.
I really don't think she's fucking anybody...I don't think she will for a long time either.
Where we are all assets and debts are put into an asset pool then the court decides what share each gets, starting point is 50:50 but that gets weighted by whether one partner brought more into the marriage, whether one partner earned substantially more, and a value is placed on domestic duties and child rearing, and future earning potential is taken into account.
If we went to court she would likely end up with 60-70% of the asset split.
We can do a binding asset agreement and file it with the court and save a lot of money and that's the path I'm hoping for.
I'm at the point of hopeful but wary...how I treat her is dependant on how she treats me.
If we keep to an amicable split I'm ok to let her take more than half but not to clean me out. 1/3 of what we've got is a lot more than half of what's left if we spend on lawyers....that said I'm going to get my own lawyer and have a chat just in case...
She has put our parenting percentages down as 95% and 5% on the separation forms which I wasn't too happy with...the usual result here is that the non resident parent gets every second weekend and half the school holidays which adds up to a bit over 20%...but I'll see how it goes once we are living apart.
If I have to file for parenting orders I will but I'd rather not.
Until she moves out she cannot get the single parent rate of government assistance nor can she claim child support payments from me as we are deemed to be parenting 50/50.
I suspect this will accelerate her moving.
